Terms of service

These terms govern purchases from and use of famicle.store. Famicle ("Famicle", "we", "us") is the seller responsible to customers. Shopify provides the ecommerce and checkout platform, and third-party production partners manufacture and ship products.

Eligibility and acceptable use

You must have legal capacity to enter a contract and provide accurate order and payment information. You must not misuse the site, interfere with its security or operation, introduce malicious code, scrape it in a harmful manner, impersonate another person, commit fraud, or infringe intellectual-property or privacy rights.

Products and made-to-order variation

Products are made to order. We aim to present colours, placement, measurements, and materials accurately, but screens and manufacturing processes can produce minor non-material differences. Product-specific descriptions, size guides, and care instructions form part of these terms. Nothing in this section excuses an incorrect, materially defective, or legally non-conforming item.

Orders and contract formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt, not final acceptance. A contract forms when we accept the order by approving it for production or sending an express acceptance, subject to applicable law. We may reject or cancel an order for suspected fraud, unavailable inventory or production capacity, obvious pricing error, unlawful delivery, or another legitimate reason. If we cancel after payment, we refund the affected amount.

Prices, currency, payment, and taxes

Prices appear in the currency displayed at checkout. The United States market is intended to transact in USD and the Canadian market in CAD after market configuration is verified. The checkout total includes applicable shipping, discounts, and taxes collected by us. Your payment provider may apply conversion or other fees. Payment must be authorized before production. Taxes are collected only where Famicle has determined and configured a legal obligation.

Shipping, cancellations, and remedies

The Shipping Policy and Return and Refund Policy form part of these terms. Made-to-order items are final sale for change of mind, incorrect size selection, and incorrect colour selection, subject always to mandatory rights for defects, incorrect goods, delay, non-delivery, cancellation, and other legal non-conformity.

Intellectual property

The Famicle name, original artwork, product designs, photography, copy, and site presentation are owned by or licensed to Famicle and are protected by applicable law. No sale transfers intellectual-property rights. Personal, non-commercial viewing of the site is permitted; reproduction, distribution, or commercial use requires written permission unless law permits it.

Third-party services

Shopify, payment processors, Printify, production providers, carriers, email services, and analytics or privacy providers may support an order. Their separate terms may govern their service to Famicle or optional functionality, but they do not replace Famicle's obligations as seller.

Disclaimers and liability

To the maximum extent law permits, the site is provided without warranties beyond those expressly stated, and Famicle is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. Any exclusion or limit applies only where lawful and does not limit liability or remedies that cannot be excluded, including non-waivable consumer rights.

Governing law and disputes

These terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without depriving a consumer of mandatory protection or a competent forum available under the law of the consumer's home jurisdiction. Changes and contact
